Welsh Women’s Aid welcomes the UK Government’s amendments to the Victims and Courts Bill which strengthen protections for children and survivors of sexual violence by restricting the parental rights of convicted rapists and child sexual abusers. These changes represent a crucial step towards ensuring that survivors and their children are not re-traumatised by being forced to maintain contact or share parental responsibility with perpetrators of serious sexual offences.
The new measures will see parental responsibility automatically restricted in cases where a child is born because of rape, and where a parent is convicted of serious sexual offences against any child. This means that offenders will no longer be able to take active steps in their child’s life, including making decisions about their schooling, medical care, or permission for trips abroad.
We particularly welcome the extension of Clause 3, which ensures that restrictions now apply to offences committed against any child, not just those for whom the offender holds parental responsibility. This recognises the profound harm caused by child sexual abuse and reinforces that individuals convicted of such crimes should not retain decision-making power over any child’s life. Too often, survivors of sexual violence have faced the devastating possibility of their abuser seeking contact or involvement in the child’s life. These measures will help prevent such re-traumatisation and affirm that the safety and wellbeing of the child and survivor come first.
Welsh Women’s Aid will continue to support survivors and advocate for a family court system that centres safety, accountability, and justice for survivors and their children.
